CCJ Appeals

• Many CCJ’s (county court judgements) are awarded against the defendant in default (Defendant not present and the judgement was awarded in favour of the creditor).
• Whether this was because the defendant didn’t receive the paperwork, did not complete and return the paperwork, mislaid the paperwork etc or simply missed the train, to the court hearing still goes ahead and the judgement stands.
• Then you are obligated to the court (court order) to pay the full amount due within 28 days from the date of hearing.
• Should you fail to pay in full and have the matter  to say that you have paid in full within the allocated 28 days. The CCJ will stay on the companies credit file for 6 years. hindering your ability to obtain commercial credit.
• A reasonably short time scale is required to be able to re-list a court hearing.
• The court will not grant a re-opening of the case if the matter is presented months thereafter.
• Once the judgement has been passed and no communication is received from the defendant, the matter is passed to enforcement where the bailiff is almost always involved and is usually, not far behind the judgement date.
• Dependant on the creditor, there are varying levels of enforcement action.
